Maldives submits its written observations in the case of The Gambia v. Myanmar at the International Court of Justice

On 28th February 2025, Attorney General Ahmed Usham, as the Agent of the Republic of Maldives, has filed the written observations of the Republic Maldives, in the case of the Application of the Convention on the Prevention and Punishment of the Crime of Genocide (The Gambia v. Myanmar), at the International Court of Justice (ICJ).

The Gambia instituted proceedings against Myanmar in the ICJ on 11th November 2019, alleging violations of the Genocide Convention through acts committed by Myanmar against Rohingya Muslims.

The Maldives subsequently submitted its Declaration of Intervention to the ICJ, and the Court, on 3rdJuly 2024, found the Maldives’ Declaration of Intervention admissible under Article 63(2) of the Statue of the Court, and invited the Maldives to submit written observations on the subject matter of its Intervention.

In accordance with the role of an intervening State under Article 63, the Maldives’ observations focused on the construction of certain provisions of the Genocide Convention, in particular Articles I, IV, V and VI of the Convention, which concern the duty to punish genocide.

The Maldives remains steadfast in its efforts to contribute to the international community’s pursuit of justice and to support the enforcement of the provisions of the Genocide Convention.
